"Young Barristers" respnds to the creation of specialization of commercial disputes in court system

The organization "Young Barristers" welcomes the decision of the establishment of specialization of commercial disputes in the common courts system and notes that judicial authorities took an important step in protecting business interests in the institutional reform process.

According to the "Young Barristers", due to the increase flow of cases in the Common Courts System and taking into account the procrastination of case discussions, the decision of the new leadership of the High Council of Justice of Georgia should positively reflect on the implementation of fast justice. At the same time, the organization expresses its interest to monitor the decisions and practices of commercial disputes that will create certain tendencies and standards based on the peculiarities of business disputes. The organization will pay attention to the fact that it is important to establish court decisions based on international best practices and standards of the European Court of Human Rights. At the same time, the organization welcomes the position of the authors of the change, that the selected judges will be retrained.

The "Young Barristers" welcomes the approach of the High Council of Justice of Georgia, society to receive fast, impartial and high quality justice. In this process, the organization is ready to work on analizys of desicions received on commercial disputes, because the court does not allow establishment of such practice, which does not arise from the essence of the law.

For information: By the decision of July 24, 2017, the amendment was made in the law " About determination of narrow specialization of judges in the Administrative and Civil boards of Tbilisi City Court’’ №1/92-2006 of October 3, 2006 of High Council of Justice of Georgia and narrow specialization of commercial disputes was founded in the administrative and civil boards of Tbilisi City Court, which is staffed bu 4 judges: Tamar Burjanadze, Levan Miqaberidze, Lasha Qochiashvili and Soso Ghurwkaia.
