Parliament must pass the antidiscrimination bill

According to evaluations of organization the “Young Barristers”, Parliament must pass the law of “Elimination of All forms of Discrimination” and along with the Church, other civil groups must be actively involved in this process as well.

According to the statements of co-founder and chief executive of the organization – Archil Kaikatsishvili, the decision concerning elimination of article from legislation, which does not precisely state scope of the law, represents consensus and concession of the legislative authority. Therefore, there is no basis for disagreement according to which a group of different opinions may oppose passage of the antidiscrimination legislation.

Based on evaluations of the “Young Barristers”, the dignity of the bill is the statement, according to which “All forms of discrimination are prohibited”. What is more, empowerment of human rights defender institute is welcomed in the process of elimination of discrimination. The organization considers passage of the bill important due to various factors, since the current antidiscrimination legislation is ineffective, absence of reaction mechanisms of judicial and administrative authorities on discriminative acts are absent and creation of judicial space for recovering rights of the discriminated.

The “Young Barristers” address the Parliament of Georgia and demand inclusion of more civil groups in discussion of the bill. The state must fulfill its obligations and pass bills concerning important challenges of the society. The church must perform and truly performs the function of intolerance of sin; however, the bill must not be evaluated as propaganda of rights of those with non-traditional orientation. We believe, that every person, politician or human rights defender who expresses these views, is not acquainted with the bill, the explanatory note of the bill, conclusions of international and local experts, common conventions and duties of Georgia in international law.

According to the statements of the “Young Barristers”, interpretations of the above-mentioned bill negatively affect the association agreement with the EU to be signed in June 2014. The passage of universal antidiscrimination bill is directly considered by action plan of Visa regime liberalization with the EU. The organization addresses every civil group to objectively evaluate the process of European integration of Georgia, foreign priorities of the country, challenges, need of democracy and rights in relationship with the EU. Therefore, every statement concerning the bill must be proved and responsible, which will make it possible to create institutional dialogues and consensus in the decision making process.
