Court of Appeals will discuss the case of Irakli Kveladze

Beginning from May 7th 2014, Tbilisi Court of Appeals will start hearing the case of Irakli Kveladze, former operator of state services development agency under Ministry of Justice of Georgia, who was dismissed by the head of state services development agency in agreement the director of Tbilisi House of Justice due to different political or civic views.

According to the lawyer of the “Young Barristers” – Nino Isakadze, Tbilisi City Court rendered an illegal decision on the case of Irakli Kveladze without taking into account presented proofs and factual conditions connected to the case. The Judge Anjeli Khurodze did not annul the order of dismissal, compensate damages of monetary loss and deny degrading statements against Irakli Kveladze just because the employer and an employee were into a temporary employment contract.

According to  evaluations of the “Young Barristers” the court did not pay attention to condition, according to which state service development agency made a decision to prolong a contractual relationship with every employee besides Irakli Kveladze, whose authority has been terminated since January 31 2013.

Tbilisi Court of Appeals will hear the case, according to which Irakli Kveladze organized preparation of letter of employees at Ministry of Justice regarding a meeting with Thea Tsulukiani in November 2012. On the meeting held on December 8th 2012, Irakli Kveladze informed the Minister on social and labor rights infringement of the employees, ban of vacation and non-use of prescribed schedule on public holidays and break periods. Irakli Kveladze also handed the minister an official documentation regarding bonus and salaries of high ranking officials stating and noted, that from this point of view, employer and an employee were in unequal conditions.

Disclosure of management by Irakli Kveladze was caused due to repressive acts committed by former executive director of House of Justice – Nino Chichua, former director of Tbilisi House of Justice – Givi Chanukvadze and former head of state services development agency Levan Samadashvili. Irakli Kveladze believes, that staff of former minister of Justice – Zurab Adeishvili evaluated his acts extremely abolishing of subordination.

Tbilisi City Court paid no attention to conclusions of internal audit service of state services development on January 23rd 2013, according to which violation of service standards by Irakli Kveladze have not been confirmed. However, state services development agency made a decision to terminate the contract with Irakli Kveladze on January 31st 2013. 

The “Young Barristers” have been advocating the case of Irakli Kveladze since February 2013.
