The „Young Barristers” – Decriminalization of Marijuana is too early

The “Young Barristers” respond to the public discussion according to which, a group of civil society demand legalization/decriminalization of marijuana. We believe, that decriminalization is too early, since this may cause increased number of drug addicts. Most often, marijuana addicts, who are short of marijuana, tend to choose stronger drugs. Therefore, decriminalization may increase the risk of increased number of drug addicts.

Below you will find a few articles from Georgian legislation concerning responsibility for drug use, drug dealing and storage.

According to 45th article of Administrative code, at small amount of drug purchase or storage, or usage of drugs without doctor’s prescription is entitled to fine of up to 500 GEL and in case of exceptions, considering the case conditions and personality of the offender – the fine may be increased to up to 30 days of administrative custody.

In case the offender voluntarily surrenders a few amounts of drugs, which he/she purchased or stored without an intention of selling, or who voluntarily addresses a hospital without doctor’s prescription concerning drug usage is entitled to be released from administrative responsibility for actions considered in the mentioned article.

According to the article 260 of Criminal code, illegal preparation, manufacturing, purchase, storage, transportation or selling of drugs, its analogue or precursors, is punishable by imprisonment for up to 11 years.

The same action committed for a large amount of drugs, by a group, by using official job position, repeatedly by the person who has already committed a number of offences provided in this chapter, is punishable by imprisonment for up to 14 years.
