The “Young Barristers” file a lawsuit against “IC GROUP” for incurred harm

20 June, 2014
Organization the “Young Barristers” have filed a lawsuit against insurance company “IC GROUP” in Tbilisi City Court demanding compensation of 4643.75 GEL incurred due to an insurance incident.

The organization has been demanding performance of contractual obligations by “IC GROUP” since September 30th 2013 but in vain; none of the letters addressed to the chief executive director of the company Temur Merzurnishvili have resulted in an action yet, in addition to this, the head of Risk Management Department Tamar Meskhidze violated professional dignity of the organization in her letter. The “Young Barristers” decided to address the court as a result of indifferent actions of the company and for the best interests of the injured party – lawyer of the organization Ana Raibuli says.

According to evaluations of the organization, “IC GROUP” is not the only company which has been actively complained against by citizens. Due to refusal of compensating the damage incurred during an insurance incident, Tornike R. has already terminated a contractual relationship with “IC GROUP”.  He was moved from Batumi to Tbilisi with an extreme form of health complications on December 21st 2012 that has been confirmed by “High Technology Medical Centre”; however, in the process of dispute, “IC GROUP” does not agree as if interventions carried out to Tornike R. in medical centre were urgent. Treatment lasted from December 21st 2012 to January 14th 2013. Remarkably, Tornike R. never needed a medical intervention later on, since a correct treatment saved his life and health.

The “Young Barristers” presented documentary proofs of incurred harm to the court. The party, which addressed the clinic with urgent stationary service on December 21st 2012, contacted the company within 24 hours after being placed in the stationary, visited the office and left a message concerning health condition of Tornike R., his urgent hospitalization in Tbilisi and compensation of expenses. What is more, plaintiff’s mother visited the insurance company 5 times since no response had been carried out by the company, did not compensate the expenses besides medical service on December 21st which afterwards was evaluated as a good will of the company.

The “Young Barristers” denies settling the dispute with “IC GROUP”. The case has been assigned to Judge Levan Gvaramia. Interests of the injured party will be protected by Archil Kaikatsishvili and Ana Raibuli.
