„Young Barristers“ – The case concerning Tamar Chergoleishvili’s position is declared to examination

On the complaint of “Young Barristers”, during the discussion, the official position of respondent Tamar Chegoreishvili was announced on 20th of June, 2014. The director of magazine/media company “Tabula”, Tamar Chergeishvili, posed a counter compaint, according to which, she will not be neglecting the offensive inquires about acknowledged reputation from the complainters’ side.  The respondent also underlines the fact, that all aspects of the dispute are of high social importance and they must be considered in the context of a public discussion

„The announcements made by the respondent via social media and media company “Rustavi Ori” shows Tamar Chergoleishvili’s subjective attitude towards the complaining organization and does not include any valid information on the connection between “Young Barristers” and any of the political parties. It is impossible to neither neglect, nor prove these documents, their assessment can be considered as a false accusation and is an essential mistake from the complainers’ side. In addition to the above, statements concerning the social issues from the respondent’s side were posed during the debates.  The organization “Young Barristers” act as spokesmen for the person introduced by the “Freedom of speech” , first article, item “I” of the Georgian law, which imposes more patience on the complainer. Tamar Chergoleishvili’s proposed statement, that complaining organization represented the “young activists of Georgian Dream”, represents respodent’s subjective attitude about “Young Barristers” and neither can be neglected, nor proved“ – as posted in Tamar Chergoleishvili’s complaint.

“Young Barristers” proof is, that respondent must neglect the offencive inquiries about her aknowledge reputation, as respondent Tamar Chergoleishvili’s statements were neither comments, thoughts, assumptions  nor evaluation. This was spread of deliberately harmful and embarrassing statements for the person.  The respondent was  offering all of her statements assertive state. The main objective of every statement was de-orientation of the society’s idea of the organization and emphasizing, that “Yong Barristers” were representing group of activists of “Georgian Dream”. The respodent’s statements’ assertive state can also be proved by the published photographic evidence, where co-founder of the organization can be seen next to Bidzina Ivanishvili.

“Young Barristers” request the court to impose Tamar Chargeleishvili to neglect the offencive inquiries of the acknowledged reputation, in particular:

  • The statement made by Tamar Chergoleishvili in news reports “Kurieri”, on media channel “Rustavi 2”, 5th February, 2014, starting from 21:23: "For sure, this is the false accusation originated from group of activists of the “Georgian Dream”, also known as “Young Barristers”…” That respondent, in the news reports “Kurieri”, being aired on “Rustavi 2”, must deny the above statement, the fact, that “Young Barristers” represent the group of activists of the “Georgian Dream.
  • To deny the statement made by Tamar Chergoleishvili via “Facebook” on 30 of January, 2014: "The activists of the “Georgian Dream” were scared away..."  That respondent must deny the above statement on “Facebook”, the fact, that “Young Barristers” represent the group of activists of the “Georgian Dream.

Additional information suggests:  „Young Barristers“ made the complaint against Tamar Chergoleishvili in Court of Law of Tbilisi on 7th of May. Tamar Chergoleishvilis critics was followed on the published investigation: “Declaration of politians’ properties and their secret business interests”, where respodent’s housband, Giga Bokeria, was mentioned for the income figures of the companies connected to his family. Organization’s interests, during court, will be defended by – Archil Kaikatsishvili, Marika Arevadze and Tinatin Niblohvili. The court took the case into consideration and the social discussion will be led by the judge Tamaz Urtmelidze.
