„Young Barristers“ – commission approved the case against “Silknet” JSC

Georgian National Communications Commition approved the investigation of “Young Barrisers”-s co-founder’s and leader’s, Archil Kaikatsishvilis complaint against “Silknet”. The committee shared the substantiation of the customer rights defendant on approving the complaint. The committee did not share legal rights defendant of “Silknet”. Accordingly, the commission accepted the presented evidence about the possible violation of Archil Kaikatsishvili’s contract from the company’s side.

On the national meeting of Georgian communications, Archil Kaikatsishvili stated hisposition. In particular, co-founder and leader of “Young Barristers” rejected coming in terms with “Silknet”. According to his statement, legal rights defendant and several other plenipotentiary people of the company presented more than one fraud documents in the case, which violates the customer rights to even greater extents. According to Archil Kaikatsishvili’s statement, addressing National Communications Commission is sensible step, because “silknet” did not fall for same mistakes with future costumers. There is a jurisdictive trust towards the commission, for the first meeting was searching for the just and objective way to address this circumstance.

The dispute concerns the neglection of obligations of the contract signed with the company on June 26, 2013. In particular, “Silknet” should have provided Vazisubani str. #7, Tbilisi with internet connection, though, during 6 months after signing the contract, company could not provide the customer with improved and uninterrupted internet connection. The problem took face of constant occurance, which company chose to ignore. “Silknet”, during 6 whole months, chose not to respond to any of the inquiries on their hotline.

On December 13, 2013, organization sent an open letter to the general director of “Silknet”, Levan Buchukuri, with request to fulfill the obligations stated in the contract. Right after this, the company decided to dispatch special groups at the emergency sites from the head quarters, and in the letter posted in February, 2014, instead of recovering internet connection they gave an explanation, that “during December, 2013, the company took the next actions: the pair was changed in the dividing cable on 10.12.2013, the modem was substituted with the new one on 18.12.2013 and 19.12.2013”, though, “Young Barristers”, who paid more than 1500 lari for internet connection during 6 months, did not get proper answer on what kind of technical difficulity was there from June 26, 2013 to December 19, 2013, what was the cause of the difficulity and was it possible or not to solve this problem without delay. More so, the company declined on providing the calls from the hot line, and in the letter of 19th of March, 2014, commercial director of “Silknet”, Nugzar Chinchaladze, pleads the contractee, to “restrain themselves from permanent and meaningless conversation.”

According to evaluation made by „Young Barristers“, actions of “Silknet” hold violations of the law and a rude tone of voice during the conversation is unacceptable for such a responsible company. Accordingly, it is not excluded, to continue the dispute in the court after National Communications Commission give their answer upon reviewing all the documents of conversations

Essential examination of the case by Georgian National Communications Commition will sbe held on 16:00, July 15, 2014.
