The "Young Barristers" won the case of illegally dismissed person from Akhmeteli Theatre

According decision of Tbilisi City Court on January 21, 2015, the claim of the “Young Barristers” against Akhmeteli Drama Theater satisfied, thereby on the case of illegally dismissed employee, Tamar Medoevi final result is acquittal.

The organization defended the interests of dismissed Tamar Medoevi on personal incompatibility motives, from Sandro Akhmeteli Theater. The administration of the theater released Tamar Medoevi on April 10, 2014. The official release document was issued by new leader of the theatre, Irakli Gogia, and can be viewed as a reorganization of staff. The reason for the release was stated to be the new schedule, which was introduced by the new leader of the theatre, upon which the committee had to run structural reconfigurations and optimization. Exactly this optimization became the reason of Tamar Medoevi’s release.

The court agreed with assertion of the “Young Barristers”, according to which, there were no organizational changes which made it essential to cut the number the personnel. The new head of the theater, in fact, did not reduce the amount of staff. Happened so, that “unfavorable” personnel were substituted by the “favorable” ones. Moreover the number of staff increased. Accordingly, that the release, on the basis of optimization, was originally inconsistent and contradicted the relevant requirements of the Georgian Labor Code.

According to the Court decision, the order of dismissal has been declared void on the grounds that the release was illegal and in violated the Labor Code. The court ordered the theater to pay, forced labor reimbursement, the amount of compensation GEL 2700.

Judge Tamaz Urtemlidze reviewed the case in Tbilisi City Court. The interest of Tamar Medovi was defended by lawyer Ana Kiknadze.
