The Georgian NGO Young Barristers makes explanations about the termination of representation in juvenile K’s case

Young Barristers considers it reasonable to inform public society and media about termination of the organization’s comprehensive advocacy and representation on juvenile K’s case. Marika Arevadze, the co-founder of Young Barristers had been a legal representative of juvenile’s interests since 2014 until the first half of 2015. On June 4, 2014, Zaza Martiashvili, Tbilisi City Court Judge has partially satisfied juvenile K’s claim and abolished mortgage agreement where the juvenile’s property was loaded. The organization managed to breakthrough and create a precedent over this complex case, as a result of what, many years fight for juvenile’s rights gained a legal perspective. Before July 4, 2015 the family had appealed to the court 7 times, however the court was repeatedly rejecting the case. The legal team of the organization had planned and implemented the strategy as a result of which the case was finely accepted on the ground of the Court of Appeals ruling.   

In order to solve different social problems, facing juvenile K’s family, the organization, Young Barristers, implemented solutions which went far beyond the scope of the local dispute:

  1. The organization provided full awareness and engagement of the diplomatic corps and International institutions about the case. The organization was publishing their official statements and evaluation of  the case and was informing the media about it;
  2. The organization provided engagement of the relevant state agencies in the problem resolution process in favor of the juvenile’s family;
  3. The organization managed to protect juvenile’s best interest and implement relevant and successful representation of the juvenile’s interest to the National Bureau of Enforcement. 2 recommendations on behalf of the Human Rights and Civil Integration Committee of the Parliament of Georgia and the Public Defenders’ Office had been issued regarding the case and the National Bureau of Enforcement was requested to act in accordance with the best interest of the child and terminate the process of eviction.
  4. The organization has managed to seize the planned process of eviction;
  5. The organization managed to attract media and public attention to the case and gain support in the public society;
  6. The organization prepared relevant appeals, statements and motions to the court which finaly had impacted court decision itself;
  7. The organization provided necessary communications and appeals, as a result of which gasification of the juvenile’s family was carried out; the Ministry of Labor Health and Social Affairs of Georgia had been supporting the family throughout the entire period. 
  8. The organization, upon the request of the family started written communication with the relevant foreign authorities necessary to get asylum for the juvenile’s family;
  9. The organization achieved to provided assistance and written communication with relevant public agency to write-off the debts of one of the parents;
  10. The organization has provided all services and affords without any agreement of legal assistance, completely for free. Moreover, the organization has provided funds for all local and international correspondence necessary for the case. 

The adverse party has appealed Tbilisi City Court decision of June 4, 2015 in the Courts of Appeals. The organization has prepared an appeal as well. in August 2015, the parents of the juvenile informed Marika Arevadze about the change of the representation. The organization would like to inform the media, interested in the progress of the case, that the representation over the case is now implemented by “Human Rights House of Tbilisi” and its lawyer Eka Kobesashvili. Marika Arevadze , the former advocate of the juvenile K and the organization Young Barristers hope that the Court of Appeal will make its decision relevant to the juvenile’s best interests.
