The organization Young Barristers, in response to the social discussion about the so called “Narushilovka” or “violation permit”, evaluates the former Prime Minister, Bizina Ivanishvili’s statement.
Archil Kaikatsishvili, the Head of the organization says, that the organization shares Mr. Ivanishvili’s opinion connected with video recordings reflecting the use of the so called “violation permit”. We consider, that the investigation should be completed as soon as possible and offenders should be punished. Naturally, it is permissible, that certain authorized persons had “violation permit”, however it should be clearly specified in the normative document exactly who and when can use it. An Act should also be prepared in a timely manner, in order not to create a vacuum, affecting operational and investigative activities. The former Prime Minister is absolutely right, while indicates that using undeserved privilege is a shame for both, the user or the grantor of such privilege.
Young Barristers talks about the necessity of the relevant legal remedies, prohibiting such inadmissible action and announces, that the organization is ready to participate in the preparation of relevant legislative acts.
„We, the civil sector should more deeply and deliberately lay criteria for liability of such officials before the law, due to ethical and moral aspects of such violations. Non-governmental sector should be more effectively involved in an inadmissibility campaign of actually irrelevant events inconsistent with free democratic and Euro-Atlantic principles and our own traditions. This is exactly what is determined by the Association Agreement with European Union. We should strengthen the fight against “violation permit” in our mountainous cities, concerned with traffic jams, huge jeeps owned by state officials and other modern manifestations of provincialism. Democracy is neither about arbitrary impunity of the ruling class, nor ignorance of law and use of illegal benefits” – states Mr. Kaikatsishvili.
Young Barristers agrees with the part of the statement made by the former Prime Minister, the Head of the NGO “Citizen”, Bidzina Ivanishvili, where he says, that: “Equality before the law is the most important value for me and I, together with each and every member of the society will do everything for its irreversible establishment.” In turn, Young Barristers is ready to cooperate with the NGO “Citizen” and lead the coalition of NGOs, fighting against violations and offences, which are inconsistent with Democratic, Civilized and Free Georgia.
Archil Kaikatsishvili considers abolishment of the secret decree on the so called “Narushilovka” or “violation permit” of 2009, as relevant decision made by the Minister of Internal Affairs of Georgia in a timely manner. The organization hopes, that in the future, new legal instruments will thoroughly control the legitimacy of issuing “violation permits”, so to avoid potential abuse of power on behalf of the officials and citizens.
