Court didn’t share „VTB Bank’s” position on the removal of enforced idleness

Chamber of Civil Cases of Tbilisi City Court satisfied demand about refunding former manager of calculation department of “VTB Bank Georgia”, on the illegal dismiss of worker of mentioned bank. A plaintiff demanded in February 12, 2018 to specify third demand of the case, which was about restitution of worker on the same position and refund for enforced idleness. The representative of the bank argued that it would be an increase of demand, which isn’t admissible for the general trial, but court remarked that restitution on the workplace is bounded with enforced idleness and specification of demand would eliminate new dispute and ensure economic principle of the court.

On the trial in April 24, 2019, court heard arguments and evidences of parties. Court remarked that general trial was scheduled for July 21, 2018, that’s why parties were eligible to represent new evidences for the case.

According to the evidences, the reason of dismiss of manager from the bank was constant humiliation from higher officials toward manager based on her social affiliation. Bank didn’t have reaction on any reference, sent by the manager. Those offences and abusive dependence caused deterioration of health conditions of the manager, which is confirmed by medical certificate.

„Young Barristers” underlines that the last agreement between employer and employee was made in March 1, 2014 until February 28, 2015. Despite this agreement must had been counted as a permanent, bank corresponded to the manager in February 25, 2015 and said that from March 1, 2015 their agreement would be ceased. A formal argument was expiration of agreement. Bank didn’t permit employee in the working place from March 1, 2015. After that, the manager demanded an order and argued that she would protected her rights in the court. This order was given only for February 27, 2017 by an assistance of lawyer.

For further information: establishment of discrimination, annulment of an order, restitution and compensation of a moral damage is demanded by a plaintiff. A suit was registered in the court in March 27, 2017. The first sitting was in February 6, 2018 in the court. In 2019, a judge was changed and now case is being considered by Maia Gigauri. The representatives of a plaintiff are Head of „Young Barristers”, barrister Archil Kaikatsishvili and lawyer Ana Putkaradze. The representative of the bank is a former judge, Tamar Shushiashvili.

The next trial will be in May 20, 2019, at 10:30.
