Organization "Young Barristers" issues a statement and express its readiness to advocate against all the employers, who exert any kind of influence on employees in the self-isolations and, indeed, creates a situation, where the employees are obliged to violate the rules of self-isolation and appear at the workplace.
"Young Barristers" addresses all the employees, who have recently been put under such pressure from the employers, to have communication with the organization. based on the Article 35 of Labour Code of Georgia, Employers shall be obliged to provide employees with a working environment that is maximally safe for the life and health of the employees. "Young Barristers" states towards the organizations and reminds them of the rights of employees, in particular, employees may refuse to perform the work, assignment, or instruction that contradicts law or, due to the lack of occupational safety standards, obviously and substantially endangers their or third person’s life, health, property, or the safety of the natural environment. Employees shall be obliged to immediately inform the employer of a circumstance being the reason for refusing to fulfil their obligations under a labour agreement.
"Young Barristers" notes out, that employers' refusal to appear at the workplace, based on the rules of self-isolation, can't be the basis for terminating the labor-legal relations, nor is it a prerequisite to deduct their salary. The organization is ready to study each of such cases and give them legal course.
The organization "Young Barristers" calls for employment organizations in Georgia, to show high professional and civil responsibility and to fully share the recommendations of the World Heal Organization and Inter-Agency Coordination Council of the Government of Georgia, in order to prevent the spread of Coronavirus (COVID-19), as well as, to defend employers' rights.
To note out, based on the statement of CDC deputy, Paata Imnadze, they have the information, that the employers bother those, who are in self-isolation, in order to force them to appear at the workplace. "We are informed, that employers bother employees, who are in self-isolation, in order for them to appear at the workplace. We refrain from giving out personal information, but if they continue to force those, who are in isolation, I will name them." - said Paata Imnadze.
