Zviad Gogiashvili, who has been beaten in the Bank, was compensated for the moral and material damages

As a result of organization "Young Barrister's" involvement, a dispute over a claim for non-pecuniary and material damages between Zviad Gogiashvili and TBC Bank and its former loan expert, M.K., has been settled. The Victim has been one-time compensated by the former employee of the bank and the bank has declined the demand on some existing credit obligations towards Zviad Gogiashvili.

Therefore, Zviad Gogiashvili disclaimed the lawsuit and any material or other damages with regard to the subject matter of the dispute towards TBC Bank and former bank loan expert, also, refused to have any claims, lawsuits and complaints not only in the Georgian Judiciary System, but also, in the Georgian Police, the Office of Prosecutor General of Georgia, in arbitration, as well as in any of the other country's court, including the European Court of Human Rights. The decision about discontinuing the case was made by the Tbilisi City Court Civil Cases Panel on March 16, 2020, which now has already entered into the force.

It is acknowledged by the public, that the incident occurred on June 3, 2019, in Tbilisi, at the TBC Bank, which is located in the "Gldani Mall" shopping centre near the Akhmeteli Theater, where Zviad Gogiashvili was physically assaulted. The citizen was physically abused by a former TBC Bank loan, causing fracture in the nose area. Based on the Gldani-Nadzaladevi District Prosecutor Office's decision, the plaintiff was identified as a victim, on June 14, 2019. The bank fired the employee and assessed the results as Zviad Gogiashvili's self-injury.

The "Young Barristers" responded to the incident on June 7, 2019, addressed the bank for public apology, and noted out, that it was preparing to launch the strategic litigation. As a result, addressed the Ministry of Internal Affairs, the Public Defender (Ombudsman) of Georgia, the chairman of the Human Rights and Civil Integration Committee of the Parliament of Georgia and with well-grounded lawsuit to the court. On July 2, 2019, the court provided the motion of receiving evidence, and the bank was obliged to release a video recorded by the surveillance cameras showing the beating fact of a citizen, which made the development of the scene visible.

"Young Barristers" welcomes the settlement precedent and notes out that, the court's efforts of settling the dispute should be appreciated, which was in plaintiff's interests, as well. Moreover, the TBC Bank's final efforts to reach the agreement is welcomed, which despite the court hearings and recorded positions, is a good example of bank-citizen relationship. The organization point out, that the precedent has been set in the Georgian banking area in order to exclude similar cases in the future.

To note out: Zviad Gogiashvili addressed the court on 27 August 2019. The judge Lia Avalishvili reviewed the case. The interest of the citizen was defended by the head of the organization "Young Barristers", Archil Kaikatsishvili.
