During the fight against the spread of coronavirus, the facts of getting infected with the new coronavirus and spreading the infection in the administrative agencies are essentially worthy of attention. It should be implied, as nowadays only such administrative units are working directly, that are responsible for the constant delivery of the critically important services.
Therefore, when in such agencies the infection still spreads, this should be the subject of a serious discussion, in order to have the right conclusions in the end and to analyze, what kind of preconditions were there for the spread of the infection and whether the supervisor took all the sufficient measures to follow the established regulations or not.
As it seems, today, one of the largest and geographically branched cluster (Tbilisi, Rustavi, Lentekhi) in the country is the cluster of the National Bank of Georgia, and that fact can be the result of large-scale negligence, in which the responsibility lies within the high-ranking officials, in charge of the activities of the NBG, including the President of the NBG, in order, if it is determined, that there was inconsecutive events done and the quality of the response was inappropriate. The head of the organization "Young Barristers", the human rights defender, Archil Kaikatsishvili made a statement about this in an interview with "Newspress".
According to him, the National Bank of Georgia is the first administrative body, where the fact of group infection of several employees with Covid 19 occurred. At this process, it is extremely important to note out, how and when the responsibility of the institution was expressed.
The NBG made the first statement on that on April 2, and noted out, when one of the co-worker was discovered with the symptoms of coronavirus, 1 week ago, other 7 employees in touch with him/her were taken to the self-isolation. Afterwards, unfortunately, it was confirmed, that they got infected with Covid 19. Even more unfortunate it is, that a person in touch with the cluster, got the virus in the Lentekhi municipality, which resulted in closing the region.
It is interesting, that the deputy of the National Center for Disease Control explained, that NBG staff got infected, whilst being in collective self-isolation, (i.e., when one team is in the closest conditions of the quarantine, so that the next team will replace it), by introducing the virus from the outside. So, the questions still remain. In particular, in such extent the NBG protected the safety of its employees in compliance with the established protocols and rules; how the outsider got in touch with the team in the self-isolation and how much time did it last. From what moment did the infection start and etc. All of these questions require a clear answer, in order to clarify, that the NBG cluster won't grow and there will be no challenge for the Central Bank to continue working in the future.
According to Archil Kaikatsishvili, when asked about the responsibility of the NBG cluster and its possible growth, the case is of employees' self-negligance or the responsibility of the NBC high officials, the issue of the institutional responsibility must arise. Based on him, the reasoning should be grounded on the Article 68 (6) of the Organic Law of the National Bank of Georgia, No current or former employee of the National Bank shall be personally responsible for his/her act or inaction with regard to any person, if he/she performed this act or refrained from it in good faith, in the course of performing his/her duties, according to the legislation of Georgia.
Moreover, the National Bank of Georgia is obliged to protect the interests of the employee, therefore, it is necessary to find out how the main bank of the country has ensured the protection of staff's health and right to life. The impression still remains, that the NBG's large-scale cluster may also be the results of large large-scale official negligence. This impressions remains, as it is noted out, that the collective self-isolation, in the literal sense may have been understood by the NBG, as at that time all the persons subject to isolation (a total of 7 or 9 persons), were placed in one apartment, in a single, rented quarantine space. This decision, which may have been taken in order to save funds, could be a result of such miserable situation.
According to him, the challenges of the NBG and the safety of its employees, despite the fact that 90% of them work remotely, should be addressed by Koba Gvenetadze, who is the president of the National bank, as well as, the chairman of the Board of the National Bank. The lawyer believes, that the outbreak of the virus in the institution is indeed the challenge, which requires at least holding the meeting of the NBG board, even remotely, so that all the existing questions will be answered.
Only, based on the high quality of the communication and direct answering to uncomfortable and awkward questions, as well as, a policy of non-avoidance of the responsibility, can be the tool to neutralize the reputation risk for the President of the National Bank, which was posed to him by the existence of a National Bank cluster.
