Dear Madam President,
In the year2016, with my daughter and mother, I came to Georgia, which I believeis the best place to start a business, for development, to create new opportunities andto attract investments to Georgia. I got familiar with the country and I decided to movefrom the Republic of Cyprus to Georgia with all my family.
On the end of the year 2017, I moved to Georgia permanently, got all the permissions in order to stay there legally and continued to do my business in Georgia, as the place, where I have to deal with business relationships, mentality, cultural experience and the legal system of the country, got to be fully acceptable and satisfying for me and for my family to decide.
The Czech Republic supports Georgia's European integration and cooperation and me personally I am great supporter of this process.
Democratic values, the rule of law, accountable and predictable state agencies – these are the main motivationsand values, which helps to protect the rights of foreigners in Georgia and makes the place more attractive for them, but during that, my family and I have faced several specific problems. Last year on August 25, 2019, from Martvili Municipality the police unmarked car came to us and demanded from my minor daughter and me to get in their carwithout any explanation, any document and without translator be present. We were abductedfrom Martvili to Batumi in that way, where no one knew, what they requested from us. The police illegally restrained our liberty, on which we already addressed Adjara Prosecutor’s Office, where the case is currently being investigated for the abuse of power by state authorities.After 10 months till now none of the police officer’s power has been suspended. It is unknown, it was an independent action of the police against me, which served the purpose to get some benefit from me, as a business person, or the policed acted on my wife’s private supporterorder, with whom I had no factual contact at that time.
This above-mentioned case completely changed my attitude towards the safe environment of Georgia and I was forced, for my family and me, including for the interests of the child, to hire private security guard. It was during that period, for revenge motives, when Georgia received complaint from the Republic of Cyprus, where my wife – a citizen of the Russian Federation of Georgian descent, Olivia Tatarashvili-Antony, demanded her daughter to be returned back to the Republic of Cyprus and accused me of moving the baby without her consent. That case is now dealt in the Georgian court and it’s not important to get acquainted with the case details, but the important and noteworthy is the reality, which fully destroys the belief towards the state institutions subordinated to the Ministries of Government of Georgia, as they make such decisions and act in a way, which isn’t appropriate for Georgia, as a EU-affiliated state and willfulness of such administrative officials undermine the protection of freedoms and rights of foreign citizens in Georgia.
On June 2, 2020, the Georgian Police and Social Service Agency launched a joint, pre-planned, agreed special operation, which aimed to remove my daughter from me and give her to Olivia Antony. The baby was taken out of her home against her will, and till now the police isn’t interested in fact, where the child is now and how safe she feels. The Prague court confirmed, that the mother is a drug user, by documents it is established, that she repeatedly put the child in danger of death, failed to develop parenting skills, had an immoral lifestyle, while from the birth date of my daughter, with my grandmother we were taken care of her and based on the document of custody signed in the Czech Republic, it is confirmed that I have exclusive custody for her. The Social Service Agency, based on the agreed actions of Ms. Nino Iobashvili and Mr. Giorgi Epitashvili, due to the fact, that in my biography there is no counterevidence, in agreement with the police, accused me of neglecting the interest of the child and has decided to issue a restraining order, moved the child by force to a family of strangers. I addressed the court and won the dispute – the court annulled the order on June 29, but the residence place of the child is still unknown. I have no contact with her. The Police doesn’t have the power to take decisive measures, and the Social Service Agency remains silence.
Today, my family and I no longer feel safe in Georgia, because, based on the information received from various sources, as a results of Social Service Agency’s actions, with an involvement of low-ranking police officers, the mother is trying to take the child out of Georgia to the Russian Federation, via an uncontrolled region of Georgia – Tskhinvali. Olivia Antony, together with her Georgian relatives, expresses separatist desire to illegally take the child from so-called illegal border. Due to the fact, that Olivia Antony is a citizen of the Russian Federation, the cross of illegal and at the same time, administratively important border isn’t a problem for her. Therefore, if the baby appears in the Russian Federation, fully, the legal basis for the final decision of the court will be removed, therefore, on the one hand, the threat will be created, that any final decision of the Georgian court can’t be enforced and, on the other hand, neither Georgia nor the Republic of Cyprus and subsequently, potentially – the Czech Republic won’t be able to return the minor citizen.
That reality has been arisen as a results of irresponsible actions of Social Service Agency and the police officers affiliated with it. They help to forcibly leave the country with my family, as my wife, who is of Georgian descent, has been able to obtain heartedness from the Social Service, as a result of greed or nepotism. They have a criminal mindset, that not all men are worthy of raising a child or all men are abusive. On this illegal misconduct the Ministry of Health and the Minister, who is fully informed about the facts, remain silence. I don’t know how, with what connections, but they managed and stopped the investigation of the case in the prosecutor’s office, which had to establish the truth on kidnapping me and my daughter. The Gagarini Police section at Tbilisi for 8 months has been delaying investigation of the case of false documents. In particular, my wife presented false documents in the court, claiming that she was employed in the Republic of Cyprus and had rental agreement there, as well. With contradictory evidences I proved, that she submitted to the court, with prior knowledge, fake documents. The court has made decision using these two fake documents, and the police have no organic interests to investigate the case and restore the court’s reputation.
If everything continues in that way, I will be forced to leave Georgia, return back to my native Czech Republic, close my office, say goodbye to Georgian employees and move the business to another country. The president is the guarantor of protecting the constitution of Georgia, guarantee of protection of rights and freedoms of foreign citizens and stateless persons in Georgia. I, as a foreign citizen, address you Madam President, in a written way and ask you, to make decision and meet me personally. I address you to get interested, why I am a subject of pursuit from the state agencies of Georgia, which should stand up for the rule of law and the protection of human rights, I address you, to protect the safety of me and my family, the safety of my child and to help me find my daughter. Today 6 year old minor isn’t in a safe environmentand for the last 40 days she is in distressed psycho- emotional state. Madam President, please give a clear example to everyone, that the juvenile justice in Georgia is really child-focused, get interested, why the prosecutor’s office and the police don’t investigate the crimes committed against me, why no one is responsible for the misconduct of low-ranking officials. Please, protect my child from kidnapping and protect my family from the violence by state agencies.
