The organization "Young Barristers" publishes the results of the monitoring, which deals with the issue of participation of the Ministries of the Government of Georgia in labor courts and labor disputes. The results of the study are for the last two years - 2018-2020.
According to the statement of the lawyer of the organization ,,Young Barristers’’ Mariam Barsonidze, 11 ministries of the Georgian government took part in the monitoring. The organization was interested in receiving and analyzing information on the following issues: In 2018-2020, in the common courts, as a plaintiff, defendant and / or a third party, how many court disputes, including labor cases, did each ministry participate in; How many court disputes ended in favor of the Ministry or against the Ministry; How many disputes ended with reconciliation;How many dismissed employees were reinstated in each Ministry; How many employees have been reimbursed because of the forced labor and / or given one-time compensation, what amount was reimbursed. How many employees are employed in each Ministry as 2021, January.
The organization notes that all ministries cooperated operatively in the current monitoringand operatively provided the requested information, except a few cases.
The organization ,,Young Barristers’’ notes that in the last two years Georgian government ministries have paid 1.010.480. 05 GEL based on court decisions for those employees, whose labor rights were violated. The monitoring showed the following results: The ministry of Internal Affairs of Georgia has paid 505,793.09 GEL. The Ministry of Regional Development and Infrastructure of Georgia has paid 164.536.90 GEL. The Ministry of Education, Science, Culture and Sports of Georgia (before split) has paid 73.420.80. The Ministry of Defense of Georgia has paid 166.729.97 GEL.
During the preparation of the current monitoring there was revealed another ministry, The Ministry of Justice of Georgia, which has paid some amount of money for the forced labor rights, but the ministry did not provide the information about current amount.
“Young Barristers” notes that in the last two years, the Ministry of Internal Affairs of Georgiahas had the most amount of labor disputes in the Georgian court and the Ministries of Justice and Foreign Affairs of Georgia have had the smallest number of disputes. Only two ministries were identified - the Ministry of Finance of Georgia and the Office of the State Minister of Georgia for Reconciliation and Civil Equality, which have not had a single dispute in the court.
The results of the current monitoring look like this:
- The Ministry of Internal Affairs- 95 cases;
- The Ministry of Education, Science, Culture and Sports of Georgia-43 cases;
- The Ministry of Regional Development and Infrastructure of Georgia-9 cases;
- The Ministry of Defense of Georgia-8 cases;
- The Ministry of Environmental Protection and Agriculture of Georgia-5 cases;
- The Ministry of Internally Displaced Persons from the Occupied Territories, Labor, Health and Social Affairs of Georgia-5 cases;
- The Ministry of Economy and Sustainable Development of Georgia- 2 cases;
- The Ministry of Justice of Georgia- 1 case;
- The Ministry of Foreign Affairs of Georgia-1 case;
- The Ministry of Finance of Georgia-0 case;
- The Office of the State Minister of Georgia for Reconciliation and Civil Equality-0 case.
According to the monitoring of the organization ,,Young Barristers’’, in the last two years government ministries have participated in 6,093 disputes as plaintiffs, defendants and / or third parties and 22,616 employees are employed in the current ministries as January, 2021.
The organization prepared the monitoring within the framework of an independent initiative. ,,Young Barristers’’ announced 2021 as the year of protection of labor rights. There is a lot of challenges in the current sphere because of the pandemic. Also, the implementation of the large-scale changes in the Labor Code of Georgia attracts special attention. In this regard, the analysis of court decisions does not lose interest and the issue of labor safety becomes even more relevant. The organization continues to advocate for a number of resonant cases in the Georgian court based on the labor law issues.
