The organization "Young Barristers" continues to provide new facts and circumstances to the public assistance agency of victims of state care and trafficking. The organization publicly makes an unbelievable case in what time With the participation of the Head of the Legal Support Department of the Care Agency, Giorgi Kupreishvili, the official text of the court enforcement sheet was rigged. The care agency asked the side to fulfil the actions that only met one side of the dispute.

The decision of 31 January of the Supreme Court of Georgia saved the father of the juvenile. The Supreme Court expressed extreme anger on the change of an official text of the Court by the Care Agency and suspended temporary execution on the family case.

According to "Young Barristers", this one concerns the family case of the businessman Stanislav Sazhin, who from March 2021 chose Georgia as a place, where he is going to live. The businessman's wife demands to return the Child to the Russian Federation. She says that the child is unlawfully displaced.

To the named case, the representatives of the so-called care agency caught a second parent's position and the father of the juvenile was mentioned as an abuser by a state-appointed lawyer. The alternative conclusions were presented on the case. Photo-video and audio materials exclude any kinds of violence.

That evidence indicates that the conclusion, which was made by the agency, was incorrect.  With the participation of Giorgi Kupreishvili, the official text of the enforcement sheet was rigged. The Care Agency requested from the father to do this kind of action which is in the interest of the opposite side of the dispute. 

In particular, the care agency informed the businessman in a letter dated January 24, 2022, that if the court decision was not enforced voluntarily, a case would be filed against him in court. In the message of the Care Agency, in agreement with Giorgi Kupreishvili, it was stated that Stanislav Sajin was in charge of: 

„1. In order to hand over the minor to the mother before 12 o'clock on January 27, 2022. Meeting in an isolated residential area of ​​Batumi. Stanislav Sazhin must have a child passport to hand over to the mother.

2. No later than January 25, 2022, Stanislav Sazhin is obliged to submit detailed information on where the child will be transferred to the mother in order to enforce the decision made by the court on January 27, 2022.

3. Stanislav Sazhin is obliged to prepare the child psychologically and emotionally in such a way as to have a positive attitude towards the mother in order to successfully enforce the court decision. "

In fact, the court decision did not oblige Stanislav Sazhin to take the actions requested by the care agency. The operative part of the court decision reads: “The minor must return to the Russian Federation with his mother. The return of the child from Georgia to the Russian Federation and the transfer of the child to the mother will be ensured by the father Stanislav Sazhin. " Thus, the organization, Stanislav Sazhin and his lawyers think that the Care Agency and the head of the legal support department of the agency, Giorgi Kupreishvili, committed a criminal act.

We note to the public that the Supreme Court of Georgia issued a ruling on January 31, 2022, thus suspending the enforcement process as an illegal administrative measure. The court is outraged by the criminal action of the care agency. In particular, we read in the court ruling: “The Chamber clarifies that the common courts make decisions on behalf of Georgia and the obligation to uphold and enforce the operative part of the decision is ensured throughout Georgia. Only the court can change the operative part of the court decision ”(Style is preserved, Judgment # AS-70-2022, p. 8).

"Young Barristers" notes that the cases of changing court decisions with the participation of the Care Agency and Giorgi Kupreishvili are not the first. In fact, Giorgi Kupreishvili tries to use such forms and means to carry out illegal and criminal measures against undesirable parties, and then to blame others. The care agency is aware of this arbitrariness but is hiding from the alleged criminal. Consequently, the ruling of the Supreme Court of Georgia of January 31, 2022, is the only, first and precedent case when the judiciary exposed the arbitrariness of the administrative officer of the executive power and the alleged crime.

The lawyers of Stasanislav Sazhin have already applied to the Prosecutor's Office of Georgia on the fact of the operative part of the arbitrarily changed court decision with the participation of Giorgi Kupreishvili, Head of the Legal Support Department of the Care Agency. The organization will continue to have a public interest in the fact and call on the prosecution to immediately investigate the fact that the court decision was falsified by the administrative body and the administrative officer.
