The “Young Barristers” demand publishing of the contract between Tbilisi Government and C.T.PARK. The contract dated Dcember 7th 2007 between the company and Tbilisi City hall, according to which Tbilisi City Hall leased the company with a right to manage a field of parking in the city until December 31st 2022, is confidential, which infringes a public interest rights and raises questions on possible corruptive deals.
According to the lawyer of the “Young Barristers” Ana Kiknadze, the contract between Tbilisi City Hall and C.T.PARK binds parties not to disclosure any information concerned in the documentations. The organization addressed Tbilisi Government to publish the contract, but no action was taken.
C.R.PARK refrains from answering questions of high public interest asked by the “Young Barristers” and states, that in case of publishing the information, infringement of contract between Tbilisi City Hall and the company would occur.
In frames of monitoring, the “Young Barristers” addressed the company to answer the following questions:
- How many citizens had holded a one year package for parking in Tbilisi costing 50 GEL until January 2014?!
- How many citizens had holded a six month package for parking in Tbilisi costing 25 GEL until January 2014?!
- How many citizens had holded one week package for parking in Tbilisi costing 4 GEL until January 2014?!
- What is one month statistical data of LLC. C.T.PARK? - according to the existing data, how many cars are fined in a one month period?!
- According to the existing data, what is the sum of resulting set of measures?
Is C.T.PARK planning to create a new parking zone in Tbilisi in 2014, what are the short-term and long-term goals of the company in developing the parking zone and how many parking areas are currently in the city?
The “Young Barristers” mark, that the contract between Tbilisi City Hall and C.T.PARK which infringes interests of the citizens, is fettering. Correspondingly, the documents are not published and it is unknown, what secret deals may exist in the issue. According to the letter of Tbilisi City Hall only, C.T.PARK paid 15. 451 658,42 GEL to local budget in 2011-2013.
Notably, the organization believes that a financial indicator as this which exists in the city, where a parking system is paralyzed, drivers purchase parking packages, but the parking area is so small, that it becomes impossible to obtain a proper service, the subject of the debate is the fairness of fining drivers by the company. On 22 March 2014, Tbilisi City Court ruled that moving of vehicles to special parking area is illegal and fine receipt was canceled, because C.T. Park never took it into consideration whether traffic was delayed or not or whether problems posed to road safety, by which interests of drivers were infringed and materially damaged them, which represented the main tool of raising the company’s income.
The “Young Barristers” state, that Tbilisi City Hall, which is responsible over creating alternative parking system in the city, does not possess a short-term strategy of unloading traffic in the city. According to the letter of city hall, a long-term plans exist only, which consider creation of a new parking zone after the Central Railway station is moved.
The organization immediately demands publishing of the contract between Tbilici City Hall and C.T.PARK and addresses Tbilisi City Assembly in order to study the issue and hold a judicial expertise of the contract.
