The “Young Barristers” sued “Silknet” in Georgian National Communication Commission

The “Young Barristers” filed a lawsuit against “Silknet” in Georgian National Communication Commission

A chief-executive and co-founder of a human rights defender organization Archil Kaikatsishvili accuses the company of breaching the contract and demands from company to fulfill imposed duties in accordance with the legislation.

The breached contract was signed with the company on June 26th 2013. In precise, JSC “Silknet” was obliged to provide internet to #7 Vazisubani street, Tbilisi; However, the company was not able to deliver quality internet uninterruptedly for six months after the contract was signed. The issue was systematically violated, which company left unresponded for 6 months. JSC “Silknet” shows negligence and no attention towards the messages left on the hot line.

On December 13th 2013, the company addressed chief-executive of JSC “Silknet” and requested performance of contractual obligations. Following this, the company decided to deliver special group to the place emergency and in the letter dated on February 2014 explained that: “On December 2013 the company carried out following activities: On 10.12.2013 the cable pair was replaced and on 18.12.2013 and 19.12.2013 the modem. However, even though the “Young Barristers” paid more than 1500 GEL for internet in 6 months, never received a prooved answer from the company on reasons of changing the cable pair on 10.12.2013 and the modem on 18.12.2013 and 19.12.2013. In addition, the company was left unanswered on what technical defects had occurred and why since June 26th 2013 up until December 19th 2013. What is more, in the letter dated March 19th 2014, commercial director of JSC “Silknet” Nugzar Chinchaladze addressed the contracting party to refrain from further permanent and meaningless conversations (Style is protected).

The co-founder and chief-executive of the “Young Barristers” Archil Kaikatsishvili demands from Georgian National Communication Commission to study legality of contractual actions, evaluate conscientiousness of the parties to the contract and determine amount of damage caused. The claim against the company is made up of 5 demands.

In order to research honesty issue of Silknet, the „Young Barristers” obtained information from Georgian Courts, according to which in 7 cases dated on or before March 31st 2014, JSC “Silknet” represented a claimant and/or defendant. 4 cases are sent back to the first instance court, 1 case is being discussed by the Supreme Court of Georgia and 2 cases are in the Court of Appeals. The organization was interested by services of other internet providers as well. Therefore, the legal group will set up monitoring on the following issue.

According to the head of the “Young Barristers” Archil Kaikatsishvili, activities of JSC “Silknet” are illegal and an abusive tone is unacceptable from a responsible company. Therefore, after decision is rendered at Georgian National Communication Commission, which has been handed all the necessary documents concerning letters with the company, the dispute may continue in court.
