With representation of „Young Barristers“, in the appealing court, the examination of the case of former operator of development of state service of the Ministry of Justice, Irakli Qveladze is renewed. On July 16, 2014, the court discussed newly presented evidences, amongst them was assertion presented at appealing complaint. The appealing chamber did not approve the acceptance of new evidences on the case and added that the side could have presented the document during the first instance. The court did not approve substantiation, that the need to present the new evidence arose after the first appealing. In addition, the court did not share the position of opposing side and allowed solicitation, to interrogate Davit A. and Teona G. as witnesses. For the information: The court also approved the solicitation of same witnesses during first instance, but in the end, it was unable to interrogate them.
“Young Barristers” state, that Tbilisi public court made an illegal resolution for the case of Irakli Qveladze, by which the evidences and and actual circumstances were not shared. The judge Anjeli Khurodze did not approve the rejection of the nulling of release document, restoration of the position, the compensation of deliberate truancy and humiliative documents against Irakli Qveladze only on the basis, that there was a validity period of the contract between employer and employee. Irakli Qveladze was released from the position on the basis of different political and social views, with the agreement between the leader of state service development, the House of Justice and the directors of the House of Justice.
According to “Young Barristers” evaluation, the court did not pay attention to circumstances, when Georgian service development agency decided to prolong the contract with employees aside Irakli Qveladze, who was stripped from authority on January 31, 2013. This was preceded by the event, when Irakli Qveladze, in November 2012, organized an open letter from the employees of the House of Justice addressed to minister Tea Tsulikiani with request of meeting. ON the meeting, held on December 8, 2012, Irakli Qveladze handed the information about violation of employees’ social and labor rights, the prohibition of holidays provided in the contract, prohibited schedules of day offs and breaks to the minister. Irakli Qveladze also handed over official document listing the honorary and wages of House of Justice officials and pointed out that there is misbalance between the employer and employee.
Irakli Qveladzes exposure was followed by repressing actions from former executive director of the House of Justice Nino Chichua, former director of the House ofJustice Givi Chanukvadze and former leader of State services and State service devoplment Levan Samadashvili. Irakli Qveladze considers, that employees of former minister of Justice, Zurab Adeishvili, took his action as abrogation of subordination and betrayal. There were interrogations and spying on the employees working space.
Tbilisi public court did not pay attention to the conclusion published by state service development agency on January 23, 2013, by which the violation of services from Irakli Qveladze’s side is not proved. Despite this, State service development decided to abolish the contract with Irakli Qveladze on January 31, 2013.
Irakli Qveladze connect his release with his political views, freedom of expression and exposure of former officials of the House of Justice. An official letter concerning this case has already been sent to the minister of justice, but the complainer does not have sufficient evidence, if minister connected the release of Nino Chachua, Levan Samadashvili and Givi Chanukvadze to his case.
The case will be examined at Tbilisi Appealing Court by the judges: Tamar Zambaxidze, Tea Dzimistarashvili and Qetevan Kuchava. The judge Tea Dzimistarashvili joined the case on July 16, 2014. The representative of interests of state services will be Mariam Tskhovrebashvili, of the House of Justice Tika Nebieridze, who also joined the case on July 16th. It is to be noted, that on meeting of July 16th, 2014, the court offered the sides a chance of reconciliation, and the appealing side stated positive position about the offer, but only with one term: if he will be restored on the same position.
