„Young Barristers“ started the preparation of legal initiative concerning student’s employment

The organization “Young Barristers” will present legal iniciative to the Georgian government on the topic of students’ employment. Legal iniciative will concern changes in various laws and are aimed to create a legal fundament for student’s employment, employments’ institutional development, formation of united approach to employment of youth and outlining government’s will about employers’ possible advantages.

According to the statement of co-founder and leader of “Young Barristers”, Archil Kaikatsishvili, the organization started working on the matter in November, 2013. They addressed Georgian government with recommendation that in case of further changes in labor code, to take student’s labor right into account. This way, the state will create student’s labor’s united system. In May, 2014, organization sent government another recommendation and offered, in parallel to increased authority of self governed units, to start working on establishing regulations concerning financing and provision of further labor for succesfull students living in the regions.  The organization, for further argumentation of the legal proposal, used the given time for researching the important directions. Foreign experience was taken into account. For further examination of the legal proposal, formation of working group was decided.

„Young Barristers“, within the legal iniciative of student employment, examined issues, which in case of perfection and argumentation, is possible to be reflected in other legal acts. Iin particular, preparation package for legal initiative includes:

1.      Establishment of minimum hourly wage for the student’s labor,

2.      Determination of maximum hours students can be employeed during the week,

3.      Regulation of the issue concerning probation,

4.      To make it possible to shorten profit of private sectors in case of student employment,

5.      Government financing and later employing successful graduates in their regions, 

6.      Establishing part-time employment in public and private sectors,

7.      Creation of electronic portal concentrated only on employment of youth,

8.      Ensuring the establishment of career management services at institutions of higher education.

During the preparation of legal iniciative, “Young Barristers” will take in mind recommendations and suggestions from working groups, which were specially chosen out of their experience towards the topic. Working group consists of specialists from private and public sectors: Ministry of Sports and Youth Affairs, Ministry of Economy and Sustainable Development, Ministry of Finance, Ministry of Labor, Health and Social Defense,  Georgian National Statistics Office, Georgian Parliament, Revenue Service, Georgian Union of Professional Connections, organizations: “Georgian Young Constitutionalists’ Association”, “The Association of Young Financers and Businessmen”, experts of economic and tax law spheres.  

Georgian Ministry of Education and Science made an argumented statement about ther rejection to join the working group, but on July 28th, 2014, “Young Barristers” addressed minister one more time ,explaining the significance of participating in the working group.

Legal group of “Young Barristers” is working on the iniciative and it is not limited from the request of any of donor organizations. Being part of the working group is non-reimbursing. The organization takes responsibility, to state recommendations of all participants of working group in the document of initiative. It is to be noted, that on possibilities f initiating issue on legal level, the organization, within the institutional dialogue with executive and legislative branches of government, already held consultative meetings and they shared the idea of preparing legal initiative on the issue.   

„Young Barristers“ plan to finish working on legal iniciative in fall, 2014, after which it will be presented to Georgian Parliament. The preparation of initiative, for certain period of time, will be coordinated by the organization’s lawyer, Nino Isakadze.
