“Young Barristers” – State should be strict to eliminate anti-constitutional actions

The "Young Barristers" applies to the Ministry of Internal Affairs to be more clarity on the issue of public safety, in particular, due to the Minister’s newspaper interview on September 10, 2014 in which some civil society prepares a conspiracy to seize and destabilize state power in autumn, in Georgia.

Co-founder and director of “Young Barristers”, Archil Kaikatsishvili states, that regarding to high public interest, it is important to specify concrete information on which article the investigation is being conducted under the Criminal Code, when it started and what is the social status of named 500 people, who, according to the Minister, is being prepared by "United National Movement" to organize a disorder.

"Young Barristers" appeals to civil society groups to pursue a special legal responsibility when there is a high probability of their use for the purposes of the opposition. The organization positively evaluates civic engagement, however it is inadmissible to implement the views of society by violation of the rule of law. If there is an assignment to involve any group in the implementation and fullfilment of anti-constitutional activities, it is essential to make public the evidence of such actions. Therefore, the organization appeales to the Ministry of Internal Affairs of Georgia, in order to prevent crime and make the proccess of investigation about the constitutional order and security transparent. 

The "Young Barristers" estimates, the collusion to change the constitutional order and the overthrowing or seize the current government by force, is punishable for a term of imprisonment from five to eight years, and the revolt to change the constitutional order and overthrowing or seize the current government is punishable for a term of imprisonment from seven to fifteen years. The legal qualification should be Article 315 of the Criminal Code. The organization believes that the investigation can be conducted by this qualification.
