According to the published research of the organization “Young Barristers”, implemented certain legal activities leave open basis to conclude that there had been a politically motivated prosecution of a person, violation of his civil rights, which ultimately ended with forcing the citizen to leave Georgia.
The objective investigation conducted on the case after October 1, 2012, confirmed that regarding Roland Bladadze in August 2004, the criminal case on charges of failure to fulfill his duties, notice the property unlawfully and unjustifiably, and then seize was baseless and artificially created by unsupported evidence. The former president Mikheil Saakashvili transferred the deprived property of Roland Bladadze to the Chairman of the Constitutional Court of Georgia - Giorgi Papuashvili in 2007, who until now lives in the house of Roland Bladadze with his family.
In 2004, a criminal prosecution against Roland Bladadze has begun without sufficient evidence, which was approved by the resolution of the Adjara Prosecutor in 12 April 2013, however, the form of giving the prosecution to the Adjara former public servant, according to the current evaluation, possessed the goal to implement further actions – the fulfillment of political decisions, according to which the property of Roland Bladadze was declared unjustified and illegal, and the government launched foreclosure process.
The resolution of the Adjara Prosecutor On 12 April 2013, completely changed all the circumstances and therefore, there is the issue of legality of the Panel Decisions in September 10, 2004 of the Administrative Law and Tax Affairs board of the Supreme Court of Adjara. In particular, whether or not the decisions based on the violations of law was enough ground to lose property right of Roland Bladadze.
The main question that the newly discovered or newly revealed circumstances has brought is related to the issue of good faith of Giorgi Papuashvili in legal relations. The fact is, that Giorgi papuashvili recieved the confiscated property of Roland Bladadze from the government under the circumstances, when there were number of ongoing disputes in courts and legitimate attorneys of Roland Bladadze demanded a suspension of the eviction from immovable property located in Batumi, Era Street # 37, provided justifications for the purchase of property by lawful means be Roland bladadze and the state represented by the President, the Parliament, judiciary institutions was informed about the dispute set to the property by family members. Although, in 2007, the newly elected Chairman of the Constitutional Court of Georgia, have disregarded the the issue of confiscated property of citizen and decided to move to the house of Roland Bladadze to live.
The organization in the framework of implemented monitoring has already addressed the recommendations to the executive, legislative and judicial authorities. English version of the research has already been sent to the diplomatic representatives in Georgia, to the Constitutional Courts of 20 European countries, to the Venice Commission and international organizations.
The “Young Barristers” started the work on the research in February 2014.
