In the case of high-ranking officials political context should not eplace the legal side

The co-founder and cheaf executive of the “Young Barristers” – Archil Kaikatsishvili, with invitation of the information-analytical portal, in the press club of “Kvira”, answered journalists' questions on the case of the Ministry of Defence officials arrest.

According to statement of Archil Kaikatsishvili,  lifting of "classified top secret” on the case is acceptable, since more openness of  the case will  make the ability to make the process transparency and will increase public confidence towards of decision-making institutitons. According to him, including the "Deltakom” case, investigation of the poisoning of soldiers, should not be applied “classified top secret" in order the process to be transparent and not speculative.

According to the evaluation of Archil Kaikatsishvili, it is unclear why the company "Slknet" lied in its statement, where it was noted that the tender of the Ministry of Defence was announced in August 2013 and was completed in September 2013, since none of the tender documents did not have, the Deputy Minister Alex Batiashvili signature. According to “Silkneti” information, the Deputy Minister on the positions had been working from November 23, 2013. Reportedly, the "Young Barristers" have released a statement saying, that the commercial director of company "Silkneti" - Bacho Chinchaladze’s mother, Mrs. Tamar Batiahshvili is Alex Batiashvili's cousin, who is the deputy of the Minister of Defence of Georgia, factual family member. The organization asked what role was played the mentioned relationship in the tender terms and conditions of the contract between company "Silknet" and Ministry of Defense. Later on, it became known that the Chief Prosecutor summoned for interrogation Deputy Minister as a witness, as indicated that in the tender documents  signatures were made by the Deputy Minister.

Archil Kaikatsishvili responded to the interrogation of Deputy Minister Alex Batiashvili on November 3, 2014 and noted ther confirmation is needed, whether the Deputy Minister’s procedural rights as a witness was violated. Note: attorney of Alex Batiashvili spread the statement, according to which, during the interrogation allegedly existed the efforts to give the desired testimony and the deputy minister did not sign the protocol.

According to Archil Kaikatsishvili, recent statements saying that the investigation should wait for the Minister to return in Georgia and then arrest their officers, through legal interpretation, means to violate the principle of the rule of law. Chief-executive of the organization, estimates responded to one opinion of the Ministry of Justice, according to which Tea Tsulukiani said that “all investigators and prosecutors should be aware of to wait to the minister when he is away on a business trip, rather than arrest the officials immediately. In case of Irakli Alasania violates the unwritten so-called “the respect ot the Minister” rule.” Archil Kaikatsishvili said that such statements from the democratic Minister in connection with other possible criminal activities is motivational and indicates political circumstances in the State prosecutor’s activities, which should not be permitted.

The “Young Barristers” requests for explanations, whether there is a selective principle, when the company won the tender of which senior officials are close to the Minister and the independent players remain beyond the state tenders. In this regard, it is noteworthy the famous event during which non-residential buildings reconstruction and capital repairs of the Ministry of Defense, carried out by LLC "Architectural Bureau", one of the founders of which and director is Tamar Valishvili, a close person of Irakli Alasania.  Above mentioned company, in 2013, won, 29.800 GEL in the tenders of the Defense Ministry.
