According to the ruling of 31 December 2014 of Khelvachauri District Court, the complaint of the Vice-Speaker of the Parliament of Georgia, Murman Dumbadze was not satisfied and MP's demand - to cancel the Court decision of 8 December 2014 and reopen the case, remained unconsidered and inadmissible.
The organization won a court dispute towards Murman Dumbadze, thereby the Court clearly indicated that statements made by Murman Dumbadze towards the organization, represented defamation and by the Court order, the Vice Speaker of the Parliament is assigned to provide compensation for damages caused by defamation, which means rejection of disseminated information about the organization in the form prescribed by the court.
In the decision of Khelvachauri District Court of December 8, 2014, which was introduced and handed to the organization by the court on December 22, are stated the following circumstances:
- The counterclaim presented on December 1, 2014 by Murman Dumbadze regarding the compliant of the “Young Barristers” remained dismissed;
- Murman Dumbadze within 1 month, when the court decision will entry into force, is ordered to publish information in the newspaper ,,Adjara" and in the Adjara TV concerning that the Khelvachauri District Court decision of December 8, 2014 (Case No. 82 0210014643017) satisfied the complaint of the NGO “Young Barristers” and founded that the disseminated reports made by Murman Dumbadze on September 19, 2014 during the Adjara TV news “Time” at 20:30 o'clock newscast and in the newspaper “Adjara” in 23-24 August, 2014 edition about the “Yong Barristers” are defamation;
- If Murman Dumbadze does not comply the action within the time prescribed, the NGO “Young Barristers” shall be entitled to carry out this action with the compensation of the necessary expenses from the defendant.
According to statement of co-founder and chief-executive of the “Young Barristers” – Archil Kaikatsishvili, the result of the case will restore public trust towards the organization's name and reputation. The goal of the proceedings is to set a precedent for similar cases by the court and high-ranking officials feel a high responsibility towards the third sector.
The legal dispute between the “Young Barristers” and Murman Dumbadze emerged, after Murman Dumbadze responded to the legal assessment of the “Young Barristers” and said in the television during interview, that “this “Young Barristers” are hired. They have no idea on the Constitution of Georgia, they have no idea what is freedom of expression, they have no idea what is freedom of speech and even more, does not know what is right and obligations of the Member of Parliament. If this government makes hired workers to do such statements, then it means that this government will turn to the government, which we dismisses.” According to the court decision, the above-mentioned statements of the Vice Speaker of the Parliament of Gerogia, Murman Dumbadze made towards the organization, as defamation now should be rejected publicly. During the litigation process, Murman Dumbadze considered presented statements in the framework of freedom of "speech and expression".
For information: the “Young Barristers” addressed a litter to the Vice-Speaker and requested to present corroborating evidences, however the Vice-Speaker of the Parliament of Georgia - Murman Dumbadze did not respond the letter. Murman Dumbadze on the organization’s complaint, only stated that ,,similar organization is not known for him." According statement of the organization, there are no legal arguments, which enables, in the case of a court decision, Dumbadze to complete successfully the appeal or cassation disputes. The court's decision has high legal justification and the fact that the judiciary didn’t approves admissible the counterclaim of the Vice Speaker of the Parliament must be taken into consideration, said Archil Kaikatsishvili.
The case was discussed by the judge Amiran Dzabunidze, the Chairman of Khelvachauri district court.
