The “Young Barristers” restored the violated right of the citizen on manipulation of the currency exchange booth

By the involvement of legal group of the organization “Young Barristers”, citizen Luka Ts. has restored the violated right by deception agreement in the currency exchange booth of one well- known exchange point network in Tbilisi. An accident took place at Tsabadze str. in Tbilisi on January 11, 2015, at which time, juvenile Luka Ts. carried out the operation in the currency exchange booth, in particular, exchanged 500 USD in the national currency. According to the Georgian legislation, the validity of the transactions by juveniles, requires approval of the transaction by its legal representative, while in this case, the legitimate representative of Luka Ts. - parent did not approve the transaction, since the currency exchange rate turned out to be inappropriately low and consumer was misled.

Lawyers of the organization focused on the circumstance that despite the fact that the parent before the child completes the deal, refused to accept the service, illegal actions was still carried out by the currency exchange. In particular, the cashier-operator, regardless of Luka Ts. and his parent’s resistance, continued exchange process, refused to return money back and issued a receipt for the purchase and sale. After these actions police was called. As a result, the police issued a protocol, which confirmed the above facts.

The “Young Barristers” addressed the company which owns the currency exchange booth with an official letter and requested that both sides return to each other the amount which was transferred, from the juvenile yet, and then by currency exchange point. After a solid justification that they violated of the rights citizens, on 29 January 2015, the contract was annulled. The victim was restored violated rights and the employee of currency exchange booth was dismissed.

For more information: according to existing legislation, the National Bank does not establish the legal rate for exchange trade, which allows the currency exchange booths arbitrarily determine the exchange rate. Due to the mentioned fact there are many cases, when citizens are misled and have to agree one-sided agreements.
