„Young Barristers“ responds to the public statement made by the member of Parliament,executive secretary of “United National Movement” ,Zurab Japharidze on February 17, 2015,according to which “so called non governmental organization “Young Barristers” is under personal control of Irakli Gharibasvili and this is proved by means of lots of avidences”(style has been preserved).Organization appeals high ranking political official, to affirm his statement by means of avidences,as the official statement of political figure is the constantation of fact and if organization’s connection with the Government is “proved by lots of avidences” ,Zurab Japharidze is responsable before his electorate and society to make at least one avidence public.
„Young Barristers“ claim that February 17 , 2015 Zurab Japharidze’s Statement made through media, is nothing more then the statement made by thoughtless and irrisponsable political official.As for the legal assessment,it represents the crime of Slander and deliberate spread of information humiliating organization’s reputation.Thus,organization refers to Zurab Japharidze to use reasonable time untill February 23, 2015 and confirm or refuse information humiliating organizations reputation by means of Media.We believe that maximum tranceperency should be used toward not unly “Young Barristers, but also towards all non-govermental organizations,so that the trust of the society to the 3rd sector was relevant and clear.In connection with ,it seems natural ,that high media interest has rised towards other NGOs,which may serve the interests of “United National movement”,perform their orders and finding out the presumable connections they way have with the leaders of parliamentary minority.
„Young Barristers“ applies to the society and gives some explanations- Activities of the organization can not be pre-agreed with any branches of the state.Everyone wishing to appraise our work,can visit official web site of the Organization.There is kind of stereotype established in Georgia: if one performs activities,cousing public interest,then this is by all means ruled from the government.In this so called “label war”,”Young Barristers ” proffesionalizm and involvements for the wellfair of the society is proved and confirmed by court decisions.When the organization had desclosed the fact of soldiers’ intoxication in the System of the Ministry of Defence, reporter of TV company “Rustavi 2” Giorgi Gabunia in the open air appraised the fact as ordered activity from so called “the Center”.We had made complaints agains Giorgi Gabunia at Georgian Charter of Journalistic Ethics.According to the decision,it has confirmed that journalist in this situation did not respect the truth and the right of society to get actual information.Meaning,the journalist has not given information,based on facts sourses of which has been proved. When the organization stated that the vice speaker of the parlament of Georgia, Murman Dumbadze was taking part in the activities of Supreme Council of the Autonomouse Republic of Adjara,Murman Dumbadze has declaired that “If the government lets such hired Organizations make statements,this means that the current government will transfer into the former governmet,who had been letted off the power”.We have accused Murman Dumbadze in the court.By decission of Khelvachauri District Court, Murman Dumbadze is obliged to publish information in newspaper “adjara” and by means of “Adjara TV” until the March 1 ,2015,regarding the issue,that “Khelvachauri District Court by the decission of December 8, 2014,has satisfied “Young Barristers” complaint (case #82 02100014643017) and has stated that the informanion broadcasted through “Adjara” TV programme “time” on of September 19, 2014 at 20:30 pm and the information published in the newspaper “adjara”,#106(23.916) edition is crime of Slander.Organization is looking forward to the resolution of one more dispute,when Tbilissi Court of Apeal will discuss tha case of Tamar Chergoleishvili-“United National Movement”leader,GiGa Bokeria’s wife, Exective director of TV “Tabula” and the Journalist,who had appraised organization research regarding sectet business interests of the family by calling organization “Georgian Dream” Activists. As a result of all, mentioned above,we do have experience and our uniquel attitude answering by legal means all the statements that humiliate professional reputation of the organization and represents a Slander. In none of this cases had been confirmed the secret cooperation of the organization with the government,so it is very important that Zurab Japharidze proved his statement of solidariy to his colegue Giga Bokeria’s family with sufficient avidences.
And in the end,society should pay attention to the representation of Nino Gvenetadze as candidate for chairman of Supreme Court of Georgia,(who had been represented by 9 other organizations together with “Young Barristers.”we wonder if mr. Japharidze considers them as the sector ruled by Prime Minister Irakli Gharibashvili as well).what was the reason that the candidate had been so negatively appraised by parliamentary minority.It is likely that time is comminfg for formation of truly independent juditial system,time for defending citizens rights and interest and high standards of pure justice,which was impossible in the framworks of Konstantine Kublashvili Democracy under one Party rule.When the majority of the society agree upon Nino Gvenetadze high professional and personal qualities,the argument,that Nino Gvenetadze represent the court of the times of president Shevardnadze,where there was high rate of corruption,seems rediculouse . It is interesting if parlamentairy minority have evidence to prove the fact of accepting bribes by Nino Gvenetadze.Clearly no such avident ever exsists,as if there was one,Nino Gvenetadze would not only be separated from the system of Justice,but also procecution against her by all means would have been started.
„Young barristers“ will ensure discussions with a defendant, Zurab Japharidze ,only after he has provided any kind of avidence.Otherwise legislator should know,that according to the 1st article of the law of Georgia on the freedom of speech and expression,slander is the essentialy false and defamatory statement to harm the person’s reputation and we are going to confirm this by court decision.
