The organization “Young Barristers”, appeals to the Minister of Economy and Sustainable Development of Georgia, Giorgi Kvirikashvili, the Minister of Justice of Georgia, Tea Tsulukiani, and the Chief Prosecutor of Georgia , Giorgi Badashvili, with the request, that , the case of Roland Bladadze, in whose house, according to the decree of president of Georgia 2007, the Chairman of the Constitutional Court of Georgia, Giorgi Papuashvili, has been living, was regarded as preferential, during the process of discussions of cases regarding confiscation of the property by the Government.
According to the statement of the chief-executive of the organization “Young Barristers”, Archil kaikatsishvili, relevant ministries of the Government of Georgia and the Main Prosecutor’s Office of Georgia, should take bold steps in order to submit fair decisions regarding such cases and return the property to it’s legal owners. The organization demands from the Ministry of Economy and Sustainable Development of Georgia, submition of effective measures and restitution of the property to Roland Bladadze, as soon as possible. Archil Kaikatsishvili appeals to Giorgi Kvirikashvili, to offer the Chairman of the Constitutional Court of Georgia , Giorgi papuashvili , alternative living space , perform the role of mediator , and return his own prorerty to Roland Bladadze . Practical experience of such mediations, have been introduced in the ministry since October 1, 2012, however, the Ministry has not defined concrete initiatives so far in the process of restoring justice in the field of property confiscations .
The “Young Barristers” appeals to the Minister of Justice of Georgia, Tea Tsulukiani, as well, and asks for assistence and share of the responsibilities by the Ministry, regarding such high profile cases. According to the announcement of Archil Kaikatsishvili , after the exhaustion of all instances of courts at the national level, the case may be submitted to the European Court of Human Rights, where, the Ministry of Justice, perpersents the party of the case on behalf of Georgia. One more complaint against Georgia and the possibility of winning this case, may result in imposing even more financial responsibilities on the State of Georgia, that doesn’t correspond neither the interests of the plaintiff , nor the possition of the defenders of Roland Bladadze’s legal interests. Therefore, the “Young Barristers” appeals to the Ministry of Economy and Sustainable Development of Georgia and the Ministry of Justice of Georgia, to make joint efforts and start impementation of the reconciliation process, in order to provide alternative living space for Giorgi Papuashvili, eradicate legal mistakes made by the former government, and restitute the property, legally owned by Roland Bladadze.
The “Young Barristers” appeals to the Main Prosecutor’s Office of Georgia ,to ensure, that the Department to Investigate Offences Committed in the Course of Legal Proceedings, pays relevant attention to the case regarding the confiscation of property of Roland Bladadze and on the backgroung of the provided documentations , objectively appraises the issue of conscientiousness of Giorgi Papuashvili’s living in the confiscated property, and if necessary , starts the criminal prosecution process against him.
The “Young Barristers” has represented the research , history of which has been publicly opened to the wide society for the first time in October ,2014. Specifically, the result of the monitoring , tells about the case of Roland Bladadze, who was one of those,whose property has been confiscated by force in 2004. The law enforcement authorities , judicial system and administarative bodies of that time, appeared to have agreed to act according to the principle of selective justice, in order to make the issue of the prosecution of public officials in Adjara visible.
The former President of Georgia, Mikheil Saakashvili, assigned the confiscated property of Roland Bladadze to the Chairman of the Constitutional Court of Georgia, Giorgi Papuashvili, in 2007 , who , together with his family, has been living here since then.
Objective investigations since October 1, 2012 regarding the case, has revealed, that the start of the criminal case with the accusation of improper implementation of the employee’s official duties against Roland Bladadze and recognition of property, legally owned by him, as illegal and unjustified, later confiscation of this property, has been based on unfounded and fictional evidences. The research has been already responded by the Venice Commission, the European Parliament and the Counsil of Europe. The English language version of the research have been forwarded to the diplomatic corps in Georgia , international organizations and Constitutional Courts of up to 20 states of Europe. The Chairman of the Constitutional Court of Georgia ,Giorgi Papuashvili , has been keeping silence regarding the issue .
