The creation of the Department to Investigate Offences Committed in the Course of Legal Proceedings by the Government, shall provide the promotion of the process of restoring justice and the society in it’s turn should take responsibility regarding the process, which is on the one hand, in correspondence with public interests and on the other hand , should not undermine state interests as well. Regarding the issue, the announcement was made during the briefing at the “kvira” press-club on March 5, 2015, by the chief axecutive of the organization “Young Barristers”.
According to the statement of Archil Kaikatsishvili, it is important , that public sector has been acted carefully while creating expactations of the society, in order not to undermine the support of the process of restoring justice, and the government had possibility for implementation of the proper strategy towards the victims of torture and those, whose property had been confiscated . Archil Kaikatsishvili has also stated , that the views of represantatives of certain non-governmental organizations, as if there are some doubts regarding the trancparency of the Department to Investigate Offences Committed in the Course of Legal Proceedings, due to the fact , that the princples for the future activities remains unknown , is can not be the objective appraisal of the issue. “ Non-governmental sector cannot dictate prosecuting bodies of the state the forms and means, by which the grave, system crimes should be investigated. This is the prerogative of relevant state agencies. The obligation of civil sector is limited by monitoring of the process and giving recommendations regarding certain issues. In this record, our effords are essentional. The announcement of the leaders of some non-governmental organizations, makes me feel, that, according to their assessment , the Office of Procecutor and the Government should pre agree the future action strategy of the Department with them. We probebly have to find some kind of space for cooperation, but not at the expence of intervention in each others activities. We are looking forward to know what kind of responsibility the Department is going to establish and how the inavitable process of restoring justice in Georgia goes on “ – stated Archil Kaikatsishvili.
The chief-executive of the organization “Young Barristers” has answered to the quastions of Media, regarding the fact of the Chairman of Constitutional Court of Georgia, Giorgi Papuashvili’s living in the confiscated property ( the house) of high ranking political official of Adjara, Roland Bladadze. Archil Kaikatsishvili appeals to the Minister of Economy and Sustainable Development of Georgia, Giorgi Kvirikashvili, the Minister of Justice of Georgia, Tea Tsulukiani, and the Chief Prosecutor of Georgia , Giorgi Badashvili, with the request, that the case of Roland Bladadze, in whose house, according to the decree of president of Georgia 2007, the Chairman of the Constitutional Court of Georgia, Giorgi Papuashvili, has been living, was regarded as preferential during the process of discussions of cases regarding confiscation of the property by the Government. According to his statement, relevant ministries of the Government of Georgia and the Main Prosecutor’s Office of Georgia, should take bold steps in order to submit fair decisions regarding such cases and return the property to it’s legal owners
Archil Kaikatsishvili demands from the Ministry of Economy and Sustainable Development of Georgia, the Ministry of Justice of Georgia and the Office of Prosecutor of Georgia, submition of effective measures and restitution of the property to Roland Bladadze, as soon as possible. Archil Kaikatsishvili appeals to Giorgi Kvirikashvili, to offer the Chairman of the Constitutional Court of Georgia , Giorgi papuashvili , alternative living space , perform the role of mediator , and return his own prorerty to Roland Bladadze . Practical experience of such mediations, have been introduced in the Ministry of Economy and Sustainable Development of Georgia since October 1, 2012 .
The “Young Barristers” appeals to the Minister of Justice of Georgia, Tea Tsulukiani, as well, and asks for assistence and share of the responsibilities by the Ministry, regarding such high profile cases. According to the announcement of Archil Kaikatsishvili , after the exhaustion of all instances of courts at the national level, the case may be submitted to the European Court of Human Rights, where, the Ministry of Justice, perpersents the party of the case on behalf of Georgia. One more complaint against the state of Georgia and the possibility of winning this case, may result in imposing even more financial responsibilities on the State of Georgia, that doesn’t correspond neither the interests of the plaintiff , nor the possition of the defenders of Roland Bladadze’s legal interests. Therefore, the “Young Barristers” appeals to the Ministry of Economy and Sustainable Development of Georgia and the Ministry of Justice of Georgia, to make joint efforts and start impementation of the reconciliation process, in order to provide alternative living space for Giorgi Papuashvili, eradicate legal mistakes made by the former government, and restitute the property, legally owned by Roland Bladadze.
