The National Communications Commission is the richest state authority of Georgia

The organization “Young Barristers” makes public the results of the monitoring, regarding the activities of the National Communications Commission of Georgia, ( hereinafter the Commission ) , according to which, the Commission turns out to be the reachest body of the state, which is not financed by the state budget, but has been provided with the colossal sum  by regulation fee  paied  in the fields of electronic communications and broadcasting, that has reached the  amount of  4,815,534.00  million GEL, according to the  incomplete data of the year 2014.

According to the statement of the lawyer of the “Young Barristers” , Nino Isakadze, during the monitoring,  issues of the salaries  and bounties given to  the Chairman  and other members of the Commission, have been analyzed ,  on the basis of the information obtained from the Commission. As the information submittied to the organization clearifies, The salary of the Commission Chairman amounts  13,312.00 GEL  and the monthy salaries of other commissioners  consists of  12,648.00 GEL.

The organization makes public the income, received  as  bounties and salaries by the former Chairman of the Commission , Irakli Chiqovani, ( Until April, 2013)  and current Chairman of the Commission , Vakhtang Abashidze, (until April, 2014 ) , also the incomes of the following commissioners : Sofio Britanchuk, Akaki Sikharulidze, Irakli Moseshvili and Kakhi Beqauri  _  for the conditions  of  not only the year of 2014.

The “Young Barristers” have requested for the information from the Commission regarding the salaries, bounties and bonuses given to the heads of the  8 structural units  of  the Commission, but the Commission refused to make these information public  due to the protection of  personal data . According to the current law, such kind of  information may be  publicly opened only  if  the  head of the relevant structural unit  agrees to this. The   Commission has noted, that despite of attempts, it was unable to obtain  such concent from the heads of any department.

The  “Young Barristers”  appeals to the parliament of Georgia  and the President of Goergia, to create critical possition and demands towards the activities of the  National Communications Commission of Georgia , due to the fact, that the effectiveness of the Commission towards the   fulfillment of  it’s  legal obligations,  has been questioned.  4 main goals and tasks of the Commission are as follows:  inadmissibility  of monopolistic activity in the field of electronic communications and broadcasting;  establishment of fair and  equal  competitive environment ;   introduction  of  modern technologies  and establishment of effective cooperation with international organizations regarding these issues;  and defene of the consumers’  legal interests. However, on the background of the challenges existing in the field of communications and broadcasting, implementation of the goals,mentioned above, are not properly ensured.  The role of the Commission in the creation of antimonopoly regulations and  competitive market ,is only symbolical.

According to the appraisal of the “Young Barristers” , in spite of  the fact,  that the  Commission is the legal entity of public law, and constant independent state authority, and is obliged to submit its activity reports to the President and the Parliament of Georgia, issue of it’s higher accountability  may become the basis for  the public discussions and introduction of new legal  regulations ,due to the fact that the source of the reveniue of the Commission is the fee paid by the authorized undertakings and liscence holder organizations in the field of electronic communications and broadcasting. And this should serve for the creation of the relevant environment in accordance with  the interests of the citizens_ the consumers .
