The organization “Young Barristers” appeals to the Main Prosecutor’s Office to hasten the investigation , launched in July 5 , 2013 , towards the Chairman of the Constitutional Court of Georgia, Giorgi Papuashvili. In accordance with the high standards of the principle of equality before the law , the society should be provided with sufficent information regarding the ongoing investigation on the criminal case , that conserns the misappropriatness of the private property by Giorgi Papuashvili, by the way of swindling.
According to the statements of the chif executive of the “Young Barristers”, Archil Kaikatsishvili, and the defender of Roland Bladadze’s legal interests, Nana Tsuladze, the official letter of Fabruary 11, 2015 , from the Main Prosecutor’s Office, , confirms the fact, that the investigation under article 180, paragraph 1st of the criminal code of Georgia _ the criminal case with the signs of swindle , is in progress. The case is regarding Roland Bladadze, whose property has been confiscated after Georgia’s “Rose Revolution” . Roland Bladadze’s house was confiscated and transmitted to the Chairman of the Constitutional Court of Georgia , Giorgi Papuashvili , for a symbolic price, 1000 GEL, on the basis of the President Saakashvili’s decree of 2007. Giorgi Papuashvili, himself, appropriated the garage , owned by Roland Baldadze, which was neither in the list of the confiscated property , nor determined by the court decision of September 14 , 2004.
The organization reveals another unlawful act by Giorgi Papuashvili towards Roland Bladade. In March , 2010 , the right on the property, specifically on the garage, owned by Roland Bladadze, has transmitted to Giorgi papuashvili , despite the fact, that it was not confirmed neither by the contract of sale of 2007 , concluded with the government, nor by any other document. On the basis of the existing evidences, it is proven, that in December 18 , 2009 , the general meeting of the landlord community was held, in order to consider one and the only issue _ transmission of the secondary construction under Giorgi Papuashvili’s ownership. As a result of the General meeting, reference to the National Civil Registry’s Batumi Office, had been prepared, in order to register secondary construction located in Batumi , Gorgasali street # 37 _ storage and garage of 35,63 M3, as Giorgi Papuashvili’s property. Landlord community was not entitled to discuss and make the decision of the property transmition to Giorgi Papuashvili, especially when the garage was not even the subject of the common ownership. According to the protocol of September 11 , 2000 of the the Batumi City Hall Technical Commission, the garage was registered under Roland Bladadze’s Ownership. Accordingly, only Roland Bladadze could be regarded as the legal owner of this property. Due to this fact, landlord community was not entitled to discuss the case of transmission of this property to someone else. Taking into account, the actions mentioned above, it is obvious, that the government has commited another illegal act against Roland Bladadze.
The organization notes, that in the mentioned case, there is a testimony evidence of the head of the landlord community, Despite the application , made by the head of the community , that the garage represented Roland Bladadze’s property, he was taken to the governor of that time, by the head of security of Giorgi Papuashvili, where the protocol for the transmission of the garage to Giorgi Papuashvili, had been prepared. The head of the community had to sign the protocol by force and his signature was confirmed by notary. In addition , it appears that, in the Archive of the National Agency of Civil Registry, documents confirming Roland Bladadze’s right to the property has been disappeared. The only record that can be found, is as follows: “According to the mantioned decision , Roland Bladadze’s garage, located in era street # 37, has been legally registered, which is not preserved in the archived materials”. This record carries the signs of another separate crime.
