The “Young Barristers” calls on the Public Defender of Georgia for the monitoring of the protest rally planned on March 21st

The organization “Young Barristers” publishes a special statement regarding the rally planned by the parliamentary opposition in Tbilisi, Rustaveli Avenue , near the Parliament of Georgia on March 21, 2015 and calls on the Government, the organizers of the event and the citizens  for  compliance  with the rules established in the Law of Georgia on the Freedom of Speech and Expression”, in order  to ensure  peaceful manifestation.

The “Young Barristers” appeals to the Public Defender of Georgia to ensure total monitoring of the rally of March 21, 2015. The organization considers, that the violations of the law or provocative and challenging situations may happen during  the manifestation . In order to locally appraise the possible risks  and  protect  the freedom of speech and expression of the citizens,  it is essential,  that such monitoring was performed by the most authoritative and  impartial authority of the country, whose direct  obligation  is to protect and supervise protection of the human rights and freedoms. Therefore, we regard, that  the  Ombudsmen’s Office should ensure the monitoring of the demonstration of 21 March,in order to objectively avaluate rally situations and after the demonstration is over, the society didn’t have to face   the questions never really  answered.

According to the announcement of the lawyer of the  “Young Barristers “, Levan Beradze, active participation of he Public Defender of Georgia together with the Ministry of Internal Affairs of Georgia in the  protection of  the rights and freedoms of the citizens confirmed by the constitution is essential. Taking into consideration the public, political and legal situation in the country, the adequate appraisal of every violation during the rally on behalf of the Government is very important. Moreover, every citizen taking part in the demonstration should realize the civil responsibility and sufficient legal liability on the violations of the public order and the law. According to the appraisal of the organization, the rally of March 21, 2015 is another test of Democracy,  that the society and the state has to pass successfully.

The “Young Barristers” reminds  of the law interpretation as well, according to which , in  organizing or   holding an assemblage or manifestation, it is prohibited to call for subversion or forced change of the constitutional order of Georgia, infringement of independence or violation of the territorial integrity of the country, also to make appeals which constitute propaganda of war and violence and trigger a  national, religious or social confrontation. Due to this reason, the organization appeals to the organizers of the manifestation for  expressing  high responsibility to the issue in order to  perform the rally in the full accordance with democratic principles. Law enforcement authority together with the citizens taking part in the rally should fully share the responsibility derived from the Georgian legislation.
