The organization “Young Barristers”, together with the lawyer Nana Tsuladze, appeals to the Prosecutor General, Giorgi Badashvili, the Minister of Justice of Georgia , Tea Tsulukiani and the Minister of Economy and Sustainable Development of Georgia, Giorgi Kvirikashvili, with a special statement, to take effective measures on behalf of the Government in order to terminate the decision, taken by the Chair of the Constitutional Court of Georgia, Giorgi Papuashvili on March 17, 2015 and implement relevant legal activities regarding the issue.
According to the barristers, Giorgi Papuashvili has completely ignored Government’s promise to the public on the timely and effective investigation of the property confiscation cases, and instead, decided to sell the disputed property through a sham deal. As the public is well aware, Giorgi Papuashvili has been living in the house, confiscated from Roland Bladadze since 2007, after Georgia’s Rose Revolution of 2003 and the property is still the subject of the legal dispute. The case of transmission of the property confiscated from Roland Bladadze is under the consideration in the Department of the Crimes Committed During Investigations of the Prosecutor’s Office of Georgia. The investigation regarding misappropriation of the garage owned by Roland Bladadze is in progress under the crime of forgery in the Investigation Department of the Autonomous Republic of Adjara. Despite this, Giorgi Papuashvili concluded real estate purchase agreement with Giorgi Levidze on March 17, 2015 . According to the agreement, the house was sold to Giorgi Levidze for 195 000 USD. Due to the demand of sequestration of the house confiscated from Roland Bladadze, expressed by Roland Bladadze’s lawyers, the National Agency of Public Registry refused Giorgi Papuashvili to recognize and thus to register the purchase agreement. For now, the process of alienation of the property legally owned by Roland Bladadze is temporarily suspended.
According to the barristers, Giorgi Papuashvili is not only an unscrupulous owner of the property, but he also concluded fictional real estate purchase agreement with Giorgi Levidze on March 17, 2015, which should be cancelled as the sham deal. The “Young Barristers” makes public Giorgi Papuashcili’s family links with Giorgi Levidze as well. Giorgi Levidze is an ex-husband of Giorgi Papuashili’s sister-in-law, Eka khoferia – the journalist at “Imedi” TV . According to the submitted information, Giorgi Levidze was going to register the property, confiscated from Roland Bladadze, on his child from marriage with Eka Khoferia. According to the appraisal, provided by the “Young Barristers”, such decision on behalf of Giorgi Papuashvili, directly contradicts the process of restoring justice. While the relevant authorities have not expressed their conclusions towards the case, an attempt to sell the disputed property, represents the direct declaration of disrespect towards the principals of the legality and justice on behalf of Giorgi Papuashvili and even more, an attempt to hide the crimes possibly committed by him.
The “Young Barristers” appeals to the following authorities:
- The Prosecutor’s Office of Georgia, to appeal to the court, make the motion regarding Roand Bladadze’s case and claim sequestration of the disputed property;
- The Ministry of Justice of Georgia, to ensure that the National Agency of Public Registry won’t recognize and thus won’t register the fictional real estate purchase agreement by Giorgi Papuashvili, on the basis of the legal substantiation provided by the party, taking into account of Roland Bladadz’e legal interest defenders’ appeal in this record ;
- The Ministry of Economy and Sustainable Development of Georgia, in order to avoid the delay of discussion of the statement providing alternative living space for Giorgi Papuashvili.
- The Common Courts of Georgia, in order not to give priority to Giorgi Papuashvili, as to the Chair of the Constitutional Court of Georgia, and not to leave the complaint by the “Young Barristers” without consideration, as if there was no legal basis for the sequestration of the property owned by Roland Bladadze.
- The Public Defender of Georgia, for implementation of the monitoring regarding the case of Roland Bladadze in order not to allow selective justice in the process of restoring justice.
- The family of Badri Patarkatsishvili, the owner of “Imedi” TV, to allow Roland Bladadze’s barristers take part in the following TV programs: “Imedis Kvira” and “Reakcia”, when the program topic will be about restoring justice in cases of the property confiscations. We announce with full responsibility, especially for the independent Television owners, that due to the journalist Eka Khoferia, the case of Giorgi Papuashvili is tabooed. The journalist, Inga Grigolia also refrains from discussion of the case. It should be noted, that despite the fact that the journalists of ”Imedi” TV have always attended the briefings by the organization regarding the case of Roland Bladadze, none from these briefings has been broadcasted by “Imedi” TV.
- To Giorgi Levidze and the citizens of Georgia , who may express their will to purchase Roland Bladadze’s property, to take into account the fact, proven by legal documentations, that the house in Batumi, Gorgasali st.#37, with the cadaster code : 05.23.17.008.01.008 was legally owned by Roland Bladadze and the legal proceedings regarding the restitution of the property is in progress.
The defenders of the legal interests of Roland Bladadze will appeal to the court against the decisions of Giorgi Papuashvili. The organization will also ensure that diplomatic corps and international organizations in Georgia were aware of the case.
