The organization, “Young Barristers”, calls the Chair of the Supreme Court of Georgia, Nino Gvenetadze, for adopting relevant decisions on time, in order to promote effectiveness of the Government activities, to regain social trust to the judicial authority of the county and to ensure high quality justice. Herewith, the organization declares its total support to the new Chair of the Supreme Court of Georgia in the judicial reform process.
According to the Chief-executive of the organization, “Young Barristers”, Archil Kaikatsishvili, formation of the fair trial out of the politically influenced one, is noticeable. However, it is also important to identify and detect major and fundamental problems of the judicial system, and submit relevant and what is more important, timely decisions. The organization will pay attention to the challenges within the judicial system, resolving which should become a priority.
- Complex approach in response to the violations of the dispute resolution deadlines, determined by law, should be established. A relevant infrastructural base should be created in order to actually help overcoming such an important judicial challenge. Considering almost every single case, judges of the Common Court in Georgia , violate the law, while court decisions are not passed in accordance with the terms, determined by the procedural legislation.
- The lack of judges is another important problem of the judicial system. More than 150 different cases are under the consideration of one single judge. The reserve judges should be appointed as judges and this institution should be actually enacted. The judicial system should be developed by means of increasing individual role of judges.
- Existence of the “privileged” and “ordinary” judges, should end _ when neither the Chair of the Supreme Court of Georgia, nor the Deputy Chairs, the Chair of the Court of Appeal and the Deputy Chairs, the Chairs of the trial chambers and the board never exercised the judges activities. There can be found no case, considered by either of them.
- National model and legal mechanism, making possible to revise the decisions of the Court of Cassation, should be created on time.
- The creation of the judges’ disciplinary prosecution mechanism should be hastened. Important human resources and administrative changes should be implemented within the judicial system. The process of raising social security should start, that will practically make the corruption, impossible.
The “Young Barristers” appeals to the Chair of the Supreme Court of Georgia with a new initiative to appoint specialized judges in order to correspond the process of restoring justice. According to the appraisal, provided by the organization, the cases regarding property confiscations during 2003-2012, should be considered only by judges, who had not dealt with the cases in the past. If within the system of the Prosecutor’s Office of Georgia, the new Department on Investigation of the Offences Committed in the Legal Proceedings was created, stuffed with the new members, it is also important that the cases of property confiscations and facts of inhuman treatment related with it, were considered by other, new judges.
The “Young Barristers” will send judicial system reform proposals to the Chair of the Supreme Court of Georgia and will continue cooperation within the frameworks of the Institutional Dialogue.
