Young Barristers appeals to the Prosecutor’s Office of Georgia and requests to conduct effective investigation in a timely manner on the disputed property owned by Giorgi Papuashvili the President of the Constitutional Court of Georgia.
Archil Kaiakatshishvili, the Head of the Young Barristers urges, that it is necessary to protect the principle of equality before the law, notwithstanding who is the party of the dispute – an ordinary citizen or the President of the Constitutional Court. The organization demands from the Prosecutors Office a fair decision on the citizen Bladadze’s case, whose property was illegally confiscated in 2004 and transmitted to the President of the Constitutional Court of Georgia, Giorgi Papuashvili on the ground of the President Saakashvili’s ordinance in 2007. Giorgi Papuashvili’s family is still living in the house legally owned by Mr. Bladadze. Archil Kaikatsishvili states, that political and legislative will with regard of Bladadze’s case should exist, so that the Prosecutor’s Office had opportunity to make fair decisions and restore justice. Otherwise, public expectations towards prosecution in the circumstances of the new Government will all be in vain.
Through its letter to the Prosecutor’s Office, Young Barristers requests to start investigation about legality and reasonableness of the confiscation of the property owned by Roland Bladadze in Batumi, Gorgasali st. #37, (cadastral code: # 05.23.17.008.01.008) and its transmission to Giorgi Papuashvili’s ownership immediately and hasten investigation in the Prosecutor’s Office of Adjara about the legality of the misappropriation of the garage owned by Roland Bladadze by Giorgi papuashvili. We consider it relevant to note, that the letter of February 11, 2015 of the Prosecutor’s Office proves, that investigation against Giorgi Papuashvili in the Department of the Autonomous Republic of Adjara is in progress under article 180 (part one) of the Criminal Code of Georgia. In 2010, Giorgi Papuashvili misappropriated Roland Bladadze’s garage, which was neither in the list of deprived property, nor itwas confiscated by the Court decision of September 14, 2004. In 2012, as a result of the dismantling of the garage Giorgi Papuashvili requested and got 3565 GEL as a compensation. This fact is confirmed in Batumi City Hall Supervision Service letter of June, 2013.
We consider it relevant to remind, that in October, 2014 Young Barristers represented a research to the public society. The monitoring tells about Roland Bladadze’s case, who appeared to be among those, whose property were illegally confiscated in 2004. Objective and impartial investigations conducted in 2012 has proved, that criminal case against Roland Bladadze was unjustified and groundless and accordingly confiscation of the property, which was implemented on the ground of the accusation was illegal as well. Specific legal actions regarding the case is still in progress.
